Terms and conditions governing the use of our website

Article 1 - Definitions

In these Terms of Use (hereinafter "ToU"), the terms below have the following meaning:

  • "Content": means all the elements constituting the information present on the Site (texts, images, videos, software, algorithms, databases) and enabling its operation.
  • "Publisher": means the company SRS MEDIA LTD, registered under number 207787318, whose registered office is located at Barzaritsa Street, 4A, ap.16, 1618 Sofia, Bulgaria.
  • "Features": means all the features made available to Users via the Site.
  • "Services": means the vehicle information reports and associated features offered via the Site.
  • "Site": means the website scan-vin.com operated by the Publisher.
  • "User": means any person accessing the Site and using its Features.

Article 2 - Purpose and Acceptance

The purpose of these ToU is to define the conditions of access to and use of the Site by Users.

Use of the Site implies full and complete acceptance of these ToU. Users who do not accept the ToU must refrain from using the Site.

The version of the ToU in force is the one accessible on the Site at the time of consultation. The Publisher reserves the right to modify these ToU at any time. The modifications come into force as soon as they are published on the Site.

Article 3 - Legal Notices

In accordance with Law No. 2004-575 of 21 June 2004 on confidence in the digital economy:

Article 4 - Description of the Services

4.1 Nature of the Services

The Site allows Users to access vehicle information reports, as part of a subscription defined by the Terms of Sale.

The Publisher strives to provide information that is as accurate as possible. However, the information present on the Site is provided for informational purposes and is not exhaustive. The vehicle reports are based on data from third-party sources that the Publisher does not verify and whose accuracy or completeness it does not guarantee.

4.2 Validity period of reports

Each report is a snapshot of the data available on its generation date and is not subject to any automatic update. It has a validity period of one (1) month from that date.

Upon expiry of that period, the report is deemed expired and its content is no longer accessible from the User's account. It is the User's responsibility to download it in PDF format before that term if they wish to keep a copy.

The User may generate a new report for the same vehicle in order to obtain updated data, under the conditions and within the limits set out in the Terms of Sale.

Article 5 - Access to the Site

5.1 Conditions of access

Access to the Site is open to any User with access to the Internet. The costs related to the connection (equipment, Internet subscription) remain the sole responsibility of the User.

The User undertakes to access the Site with equipment in good working order, protected against viruses and equipped with an up-to-date browser.

5.2 Availability

The Site is in principle accessible 24 hours a day, 7 days a week. However, the Publisher reserves the right to temporarily suspend access to the Site for maintenance or update reasons. As far as possible, the Publisher will inform Users of scheduled periods of unavailability.

5.3 User Account

Access to the Services requires the creation of an account. The User is solely responsible for the accuracy of the information provided during registration and undertakes to keep it up to date.

The User is solely responsible for the confidentiality and security of their login credentials. Any use of the account is deemed to be carried out by the User. In the event of loss, theft or suspicion of fraudulent use of their credentials, the User must inform the Publisher without delay via the contact form.

Article 6 - User Conduct

The User undertakes to use the Site in a manner consistent with these ToU and the applicable legislation. In particular, they are prohibited from:

  • using the Site in a way that harms its proper functioning or security;
  • introducing viruses, malware or any unlawful content onto the Site;
  • attempting to gain unauthorized access to the Publisher's computer systems;
  • using the Site for unauthorized commercial solicitation purposes;
  • systematically extracting data from the Site by automated means (scraping, robots, etc.).

Article 7 - Intellectual Property

7.1 Publisher's rights

All the elements making up the Site (texts, images, graphics, logos, icons, software, databases, Site structure) are protected by the laws in force regarding intellectual property and constitute the exclusive property of the Publisher or its partners.

Any reproduction, representation, modification, publication, distribution or exploitation, in whole or in part, of these elements, without the prior written authorization of the Publisher, is strictly prohibited and constitutes infringement within the meaning of articles L.335-2 et seq. of the Intellectual Property Code.

7.2 Prohibitions

The User is prohibited from:

  • copying, reproducing or distributing all or part of the Site's Content;
  • creating derivative works from the Content;
  • modifying, translating, adapting or arranging the Content;
  • disassembling, decompiling or reverse-engineering the Site.

7.3 Trademarks

The Publisher's word and visual marks (logos) are protected. Their use without prior written authorization is prohibited.

Article 8 - Liability

8.1 Publisher's liability

The Publisher undertakes to implement the means necessary for the proper functioning of the Site. However, it does not guarantee that the Site is free of errors or that it is accessible without interruption.

The Publisher cannot be held liable for:

  • malfunctions related to the Internet network, the User's equipment or third-party software;
  • indirect damages (loss of data, loss of opportunity, commercial loss) resulting from the use or impossibility of using the Site;
  • the content of third-party sites accessible via hyperlinks present on the Site.

8.2 User's liability

The User is solely responsible for the use they make of the Site and the Services. They are also responsible for the protection of their computer equipment and their data.

Article 9 - Personal Data

The Publisher processes Users' personal data in accordance with the General Data Protection Regulation (GDPR - EU Regulation 2016/679) and the applicable legislation on data protection.

The procedures for collecting, processing and storing personal data are detailed in the privacy policy accessible on the Site.

The User has a right of access, rectification, erasure, restriction, portability and objection to the processing of their data, which can be exercised via the contact form.

Article 10 - Hyperlinks

The Site may contain links to third-party websites. The Publisher exercises no control over these sites and declines all responsibility for their content, their availability or their data protection practices.

Any hyperlink pointing to the Site from a third-party site requires the prior authorization of the Publisher, which may be requested via the contact form.

Article 11 - Partial Nullity

If one of the clauses of these ToU is declared null or inapplicable, this nullity will not affect the validity of the other clauses, which will continue to produce their effects.

The fact that the Publisher does not invoke a clause of these terms at a given time cannot be interpreted as a waiver of the right to invoke that clause subsequently.

Article 12 - Language

In the event of a translation of these ToU, the French-language version prevails in the event of a divergence in interpretation.

Article 13 - Applicable Law and Dispute Resolution

These ToU are governed by the law of the European Union and, on a subsidiary basis, by Bulgarian law.

In the event of a dispute relating to the interpretation or execution of these terms, the parties undertake to seek an amicable solution prior to any legal action.

Users residing in the European Union may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Failing an amicable resolution, the dispute will be submitted to the competent courts according to the rules of common law. For Users acting as consumers, the rules of territorial jurisdiction of their place of domicile apply in accordance with the regulations in force.

Article 14 - Assistance

The Publisher's technical team provides assistance from Monday to Friday, from 8 a.m. to 7 p.m. (Paris time), excluding public holidays, exclusively via the contact form available on the Site.
